Privacy Policy

1 General

Users’ privacy is important to us and we are committed to protecting the information the User entrusts to us. By using the Site or the Service, the User consents to having his/her personal data transferred to and processed in Finland. The Company holds the right to move the data and data processing to another country. The following policy including the register legend sets forth the manner in which Zokem collects and uses information gathered from the users of this Services and Site.

2 Use and Collection of Data and Information

Zokem may collect personally identifiable information from Users in a variety of ways, including through online forms and other instances where Users are invited to volunteer such information. Zokem may also collect information about how Users interact with websites, device and device applications and features. This information is obtained through analysis of logs and through the use of “cookies” placed on user machines. A cookie is a piece of software that a Web server can store on a PC to identify the User should they visit the website again. While not all of the information that Zokem collects from Users is personally identifiable, it may be associated with personally identifiable information that Users provide us through our website.

Zokem may use personally identifiable information collected through its website to contact Users regarding products and services offered by the company and its trusted affiliates. We may also use information collected through Zokem’s mobile service and website for research regarding the effectiveness of the service and the marketing, advertising and sales efforts of Zokem, and its trusted affiliates.

Zokem will not disclose personal information about customers or users without express permission unless the release of said information is required by government subpoena. Zokem cannot sell data related to any individual specifically. However, Zokem can use individual data in targeting communication and marketing activities. By accepting Zokem user agreement and privacy policy, the user opts in to receive targeted marketing and communication activities through e.g. notifications sent by Zokem. Zokem can use, process, analyze, visualize and sell aggregate data, related not to any individual specifically, but instead to a group of people. This data would include e.g. statistics related to traveling in foreign countries, or time distribution of service usage activity, all calculated over groups, and thus not reported on the level of individuals.

The User may opt-in for sharing his/her own information with other users or third parties. The User gets to decide upon different alternatives given by Zokem, which personal data may be shared and used by third parties. Such data may include, but is not limited to Communication statistics such as phone calls (time, name and number of the other party) and messaging, messages to the social network, profile and other status information, calendar information, use of media (music etc.), device-level statistics (use of applications, location, time and other similar information). The User is in control of sharing of personal information and data, and no private information will be shared with anybody else than the User without the prior consent (opt-in) by the User.

3 Disclaimers

Zokem is not responsible or liable in any manner for any User Content or Third Party Applications, Software or Content posted on the Site or in connection with the Service, whether posted or caused by users of the Site, by Zokem, by third parties or by any of the equipment or programming associated with or utilized in the Site or the Service. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users post, transmit or share on the Site and are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content you may encounter on the Site or in connection with any User Content or Third Party Applications, Software or Content. Zokem is not responsible for the conduct, whether online or offline, of any user of the Site or Service.

The Site and the Service may be temporarily unavailable from time to time for maintenance or other reasons. Zokem assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. Zokem is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to User’s or to any other person’s computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Web and/or in connection with the Service, including any Mobile Client software. Under no circumstances will Zokem be responsible for any loss or damage, including any loss or damage to any User Content or personal injury or death, resulting from anyone’s use of the Site or the Service, any User Content or Third Party Applications, Software or Content posted on or through the Site or the Service or transmitted to Users, or any interactions between users of the Site, whether online or offline.

Zokem reserves the right to change any and all content, software and other items used or contained in the Site and any Services and Platform Applications offered through the Site at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by Zokem.

4 Termination of Membership and Deletion of Personal Information

Zokem may terminate user’s membership, delete his/her personal information and data including the profile and any content or information that the User has posted on the Site or through any Platform Application and/or prohibit the user from using or accessing the Service or the Site or any Platform Application (or any portion, aspect or feature of the Service or the Site or any Platform Application) for any reason, or no reason, at any time in its sole discretion, with or without notice.
5 Governing Law, Venue and Jurisdiction
By visiting or using the Site and/or the Service, the User agrees that the laws of Finland, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between the User and Zokem or any of its affiliates. The User agrees not to commence or prosecute any action in connection therewith other than in the courts of Finland, and the User hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction of Finland.

6 Submissions

The User acknowledges and agrees that any questions, comments, suggestions, ideas, feedback or other information about the Site or the Service (“Submissions”), provided by the User to Zokem are non-confidential and shall become the sole property of Zokem. Zokem shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to the User.

Purpose of Processing Personal Data

Zokem may use personally identifiable information collected through its website to contact Users regarding products and services offered by the Company and its trusted affiliates. Zokem may also use information collected through its website for market, commercial or scientific research.

Content of Data File

Data submitted by the consenting customer upon registration, including personal information, and contact details (country of residence, address, phone number and email), as well as information or data required for using and producing Zokem products and services, including the necessary information concerning invoicing or billing.

Data collected from the User’s device upon its consent (i.e. the User has opted-in for the collection of such data) including e.g. statistics related to Communication such as phone calls, messaging, messages to social network, profile and other status information, calendar information, use of media (music etc.), device-level statistics (use of applications and location, time and other similar information).

Source of Data File

Data submitted by the User upon registration and placing an order. Data collected by the mobile client downloaded and installed by the User and to the collection of which the User has given its specific consent. Data submitted by the User in the Service.

Disclosure of Data File

Zokem does not primarily disclose private contact data to third parties without the express prior consent of the User, unless it is required to fulfill an order or other action, which the User has consented.

In protecting the physical and electronic Personal Data File Zokem Ltd uses all necessary preventive means of technical and knowledge-based protection as required by the applicable law.

Right of Access

The User has the right to access Zokem Ltd’s Personal Data File to the extent of data concerning the User him/herself. The request for accessing the Personal Data File must be conducted personally by appearing in the premises of the Company or through means of a personally signed letter addressed to Zokem (Meri-Tuuli Kupiainen, Zokem Ltd, Innopoli II, 02150 Espoo, Finland). The information shall be provided in writing upon request. The right to access the Personal data File is free of charge when requested once in every twelve month time period.

Retrification

Zokem shall, on its own initiative or at the request of the User, without undue delay rectify, erase or supplement personal data contained in its personal data file and erroneous, unnecessary, incomplete or obsolete as regards the purpose of the processing. The request must be addressed to the representative of Zokem (contact details above) in writing with an intelligible description of requested information and necessary search criteria.
